Terms of Service

These Terms of Service (“Terms”) govern access to and use of footyGPT, including our website, chat, and related features (the “Service”). By creating an account, buying credits, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who we are

The Service is operated as “footyGPT” (“we”, “us”, “our”). Contact: hello@footygpt.com. We provide AI-assisted football research and related information tools. We are not a bookmaker, payment agent for bets, or a licensed gambling operator. We do not accept or place bets, hold customer gambling funds, or pay out winnings.

2. Eligibility — 18+ only

The Service is for adults aged 18 years or over only. You represent and warrant that you are at least 18, that you have the legal capacity to enter this agreement, and that using the Service is lawful where you live. You must not use the Service if you are under 18, if you are self-excluded from gambling, or if local law prohibits you from accessing gambling-related content.

We may suspend or terminate accounts if we believe a user is under 18 or is using the Service in breach of these Terms. You are responsible for ensuring that anyone using your device or login is 18 or over.

3. Not financial advice, not gambling advice

Nothing on the Service is financial advice, investment advice, regulated advice, or a personal recommendation to bet, gamble, buy, sell, or otherwise deal in any market or product. We are not authorised or regulated by the Financial Conduct Authority (or any equivalent regulator) to provide financial advice. Outputs are general information and entertainment / research only. They are not tailored to your circumstances, bankroll, or risk tolerance.

References to odds, markets, selections, accumulators, bet builders, “leans”, “value”, or similar language are illustrative research framing only. They are not instructions to place a bet, and they are not an offer to take a bet.

4. Gambling involves risk

Gambling can be addictive and you can lose money. Never stake money you cannot afford to lose. Past results, model outputs, and historical odds do not predict future outcomes. If you choose to gamble with a third-party bookmaker, you do so entirely at your own risk. We are not responsible for any bets you place, any losses, or any dispute with a bookmaker.

5. AI outputs can be wrong

The Service uses large language models and third-party data (including fixture, odds, and statistics feeds). Content may be incomplete, outdated, inaccurate, biased, or invented (“hallucinated”). Team news, line-ups, kick-off times, scores, and prices change quickly. You must independently verify anything material with official competition sites, licensed bookmakers, and other primary sources before you act.

We do not warrant that any selection, scoreline, acca, or other output will win, be available to bet, or match any bookmaker’s market. We do not guarantee uptime, response quality, or that odds shown equal any particular book’s price.

6. Your account

You must provide a valid email and keep your login details confidential. You are responsible for activity on your account. Notify us promptly at hello@footygpt.com if you suspect unauthorised use. We may refuse, suspend, or close accounts for suspected abuse, fraud, underage use, or breach of these Terms.

7. Credits, payments, and refunds

Paid features are billed as gameweek subscriptions described at checkout. Payments are processed by Stripe. Prices are shown before you pay. Credits are for use on the Service and have no cash value except where consumer law requires otherwise. Unless required by law, credits are non-transferable and unused credits are not redeemable for cash. Gameweek subscriptions renew weekly until you cancel. Unused credits from a gameweek subscription expire at the end of that gameweek, including extra credits added during the same gameweek. Optional auto-refill charges your saved card once per gameweek if you run out.

If you are a consumer in the UK or EEA, you may have a legal cooling-off right for digital content. That right may be lost once you ask us to start supplying digital content (for example by using credits to generate answers) and you acknowledge that performance has begun. If a purchase fails due to our fault, contact us and we will reasonably investigate a refund or credit. Chargebacks for completed, used services may result in account suspension.

We may change prices or free allowances. Changes do not affect purchases already completed except as required by law.

8. Acceptable use

You must not:

  • use the Service if you are under 18;
  • scrape, overload, reverse engineer, or resell the Service without our written permission;
  • attempt to bypass credit limits, security, or access controls;
  • submit unlawful, harmful, or infringing content, or use outputs to harass, defraud, or mislead others;
  • present our outputs as licensed betting products, guaranteed tips, or as advice from a regulated professional;
  • use the Service in any jurisdiction where it is illegal for you to do so.

9. Intellectual property

We and our licensors own the Service, branding, and software. You retain rights in the prompts you submit. You grant us a worldwide, non-exclusive licence to process prompts and outputs as needed to operate, secure, and improve the Service (including abuse prevention and quality). You must not copy the Service or use our marks without permission.

10. Third-party services

The Service relies on third parties such as hosting, authentication, payments, AI model providers, and sports data providers. Their terms and availability are outside our control. Links to bookmakers, help organisations, or other sites are for convenience only; we are not responsible for those sites.

11. Availability and changes

We may modify, suspend, or discontinue any part of the Service, including models, data sources, and features (such as public research pages). We are not liable for interruption, data loss, or discontinued features except where we cannot legally exclude that liability.

12. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under English law (including certain consumer rights under the Consumer Rights Act 2015).

Subject to that: we provide the Service “as is”. We exclude implied warranties to the maximum extent permitted. We are not liable for betting or other financial losses, lost profits, lost opportunity, indirect or consequential loss, or loss arising from reliance on AI output, odds, or fixture data. Our total aggregate liability to you in connection with the Service is limited to the greater of (a) the amount you paid us for credits in the 12 months before the claim and (b) £50.

You use third-party bookmakers entirely at your own risk. We are not a party to any bet.

13. Indemnity

You will indemnify us against claims, losses, and costs arising from your misuse of the Service, your bets or other activity with third parties, or your breach of these Terms, except to the extent caused by our fraud or negligence that we cannot legally exclude.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms, if we must do so for legal or security reasons, or if we shut down the Service. Sections that by nature should survive (including 3–5, 9, 12–13, 15–16) remain in effect.

15. Changes to these Terms

We may update these Terms. The “Last updated” date will change. Material changes will apply going forward. Continued use after the update constitutes acceptance. If you do not agree, stop using the Service.

16. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that UK consumers may also bring proceedings in their local courts where the law allows.
